My Type of Girl

How's this for a stand up lady?  I think justice is being served.

Wait. I don't get it. The husband was acquitted of murder because the wife told him she was raped? Since when is rape legally grounds for murder?

The husband was acquitted and the wife was charged with murder because she lied by saying it was rape when she was actually having an affair. She was the cause of the murder, so she was charged and found guilty.

Right. So isn't that like saying that killing a man who commits rape is justified by the law? They're essentially saying, "well, he shouldn't be accountable for that murder because he thought she was raped." So that means that if she actually was raped, nobody would be charged with anything.

I think you're allowed to shoot someone if you catch them in the act of raping your wife.

To be clear, she was in the middle of screwing her lover, and when her husband caught them, she started screaming that the guy was raping her.

Um...no. She was put in jail for this dude's murder. She's being punished for lying about being raped and causing a man to be killed...yeah? Isn't that what the story indicates?

I'm not lead to believe that if she had been raped the husband would get off without any charges. Though...he did still pull the trigger. So...now that I'm thinking this out as I type, there should be some charges against him, as he did shoot a guy. Yeah. I think I just invalidated my point.

While I don't necessarily disagree, I don't think that's actually backed up by the law.

The grand jury refused to indict him. It may not be backed up by the law; but if you go in front of most juries, I'd think you would get off.

I think there are many situations where someone tried for inflicting harm on someone found fucking the wife would be declared not guilty (or declared guilty but given very minor sentencing) even if the wife wasn't accusing her lover of rape.

The prosecution knew this, and instead of blaming him (where he would be tried and be declared not guilty); she was tried and convicted instead. And I believe rightly so.

"I think you're allowed to shoot someone if you catch them in the act of raping your wife.

I think it is backed by the law - defense of person and/or property. A violent crime is being committed against you/your family, you respond to protect them. I think this kind of language is included in most states' self-defense statutes (it is in GA).

Also, this woman knew damn well that there were going to be some repercussions from her saying this dude was raping her in front of her husband who found them. She also knew damn well that her husband owned (and carried) a gun. She can get anywhere from probation to 20 years, so I can't speak on whether the sentence is fair but I'd say 5-8 years would be appropriate. 20 would be too much.

While I would never go so far as to say he got what he deserved, I will say, however, that any time you have an affair with a married person (or even a single person in a relationship), you run the risk of bringing a world of hurt upon yourself.

It would be very interesting to see a statistical breakdown of how often it results in homicide when a man walks in on his wife cheating on him. (Or the other way around.) My guess is 15% of the time.
